1. Acceptance of Terms

By accessing or using the website of Elevano Agency (incorporating MSME: **UDYAM-BR-34-0060562** and GSTIN: **10DWZPK6586D1Z2**), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.

2. Scope of Services

Elevano Agency is a full-service digital growth partner offering customized professional solutions:

  • Web Development, App Engineering, and Custom Solutions.
  • Graphic Design, Visual Branding, and Copywriting.
  • Digital Growth Marketing, Social Media Campaigns, and SEO.
  • Video Post-Production and Virtual Administrative Assistance.

All custom deliverables and project scopes are detailed and governed by individual written Statements of Work (SOW) signed between Elevano and the client.

3. Intellectual Property Rights

Unless otherwise agreed in a separate SOW:

  • Client Deliverables: Upon receipt of full and final payment, client owns the copyright of the final graphic assets, site content, and custom code engineered specifically for the client's project.
  • Elevano Ownership: Elevano Agency retains full ownership and intellectual property of any pre-existing code libraries, generic frameworks, methodologies, widgets, background engines, or tools used during development.

4. Client Responsibilities & Co-operation

To deliver top-tier, fast, and high-performance digital projects, clients must:

  • Provide timely and accurate feedback, access credentials (hosting, domains, API tokens), copy drafts, or graphic requirements as outlined in project milestones.
  • Acknowledge that project deadlines are dependent on prompt feedback. Delay in providing required assets will result in milestone extensions.

5. Payment, Invoicing & Billing

Terms of payments, advance retainers, and billing milestones are set forth strictly in our statements of SOW:

  • All invoices are detailed, transparent, and subject to legal GST additions (GSTIN: 10DWZPK6586D1Z2) where applicable.
  • Payments are strictly due within the designated timeline stated in the invoice. Delay in payments will result in temporary suspension of project operations and server hosting deployments.

6. Limitation of Liability

In no event shall Elevano Agency, its co-founders (Sahil Basnet and MD Monazir Khan), or operational teams be liable for any indirect, special, incidental, consequential, or punitive damages. This includes, but is not limited to, lost business profits, data corruption, network outages, hosting suspensions, or search engine ranking shifts.

7. Governing Law & Jurisdiction

These Terms of Service and any project dispute shall be governed by, construed, and enforced in accordance with the laws of India. Any legal proceedings or dispute resolutions arising out of these terms shall be subject strictly to the exclusive jurisdiction of the courts located in Sitamarhi, Bihar, India.

8. Changes to Terms

We reserve the right to revise or update these Terms of Service at any time. When updates occur, we will revise the "Last Updated" date at the top of this page. Your continued use of the website and our services after modifications constitute acceptance of the updated terms.
